Girlielingerie LLC Affiliate Program Terms and Conditions
1. Program Overview
The Girlielingerie Affiliate Program (“Program”) is operated by Girlielingerie LLC (“we,” “us,” or “our”) and allows approved individuals (“Affiliates” or “you”) to earn commissions by referring customers to girlielingerie.com (“Site”) using unique tracking links or promo codes.
By applying to or participating in the Program, you fully and unconditionally agree to these Terms and Conditions (“Terms”). We reserve the right to modify the Program or these Terms at any time. Continued participation after any changes constitutes your acceptance.
2. Eligibility and Enrollment
To participate, you must:
• Be at least 18 years old (or the age of majority in your jurisdiction of residence, whichever is greater).
• Be a legal resident of the United States (including the 50 states and the District of Columbia) or Canada.
• Have an active public social media account (e.g., Instagram, TikTok) with a minimum of 5,000 genuine followers.
• Promote through channels that align with our brand aesthetic.
We evaluate applications in our sole discretion based on the above criteria, brand alignment, and overall fit. Corporate entities, employees/officers of Girlielingerie LLC, and related parties are ineligible. The Program is void where prohibited by law.
Upon approval, you will receive access to the affiliate portal to generate tracking links/codes, view statistics, and manage your account. You must keep your login credentials secure.
3. Commissions and Payouts
• Commission Rate: 12% of Net Sales from Qualifying Sales.
• “Net Sales” means the amount actually received by us from eligible products after all discounts, returns, refunds, chargebacks, taxes, shipping, handling, and gift cards.
• Qualifying Sale: A completed, tracked purchase by a referred customer that is not canceled, returned, refunded, charged back, or determined to be fraudulent. You earn no commission on your own purchases or those of immediate family/household members.
• Attribution Window: 30 days from the first click on your tracking link or use of your code (last-click attribution applies unless otherwise stated).
• Earning Date: Commissions are earned and confirmed only after the applicable return period (30 days) has closed.
• Payout Schedule: Commissions are processed and paid between the 1st and 5th of every month for amounts earned and confirmed in the prior period, provided your balance meets the minimum payout threshold of $100 USD. Balances below $100 roll over to the next month.
• Payments will be made via PayPal or bank transfer. We may use third-party payment services to facilitate these payments; you agree to their terms and release us from liability for their handling of payments.
• You are solely responsible for all taxes on commissions earned. We may require tax forms (e.g., W-9 for US residents or equivalent for Canadian residents) as required by law. We reserve the right to withhold or reverse commissions for violations, fraud, returns, or chargebacks.
4. Promotional Rules and Obligations
You may promote the Program using approved tracking links/codes, honest reviews, social media posts, email to opted-in lists, blogs, videos, and similar methods, provided you comply with all applicable laws and these Terms.
You must:
• Make clear and conspicuous disclosures of your affiliate relationship in every promotion (e.g., “#ad”, “#affiliate”, “I may earn a commission if you purchase through this link”, or “Affiliate link – I earn from qualifying purchases”). Disclosures must be prominent, visible before any call-to-action, and easy for ordinary consumers to notice and understand (in line with FTC Endorsement Guidelines in the US and equivalent Canadian standards).

◦ For videos: Include verbally and on-screen at the beginning (and periodically for longer content).
◦ For stories or short-form content: Use a clear visual on-screen disclosure
◦ Use only approved creative assets or text from our media kit.
◦ Represent our brand positively and in alignment with our sexy, confident, playful aesthetic.
◦ Tag/mention us appropriately (e.g., @girlielingerie).
◦ Comply with all applicable laws, including anti-spam rules (CAN-SPAM in the US, CASL in Canada), data privacy (CCPA/CPRA, PIPEDA), and advertising regulations.
Content Guidelines:
All promotional content must be:
• Your own original work reflecting genuine experiences and honest opinions.
• Depicting only adults 18+ (with proper consent if others appear).
• Free of false, misleading, or unsubstantiated claims (including any medical, health, or guaranteed results claims).
• Free of price information (prices and availability fluctuate).
• Free of content that could mislead about product fit or appearance.
• Free of obscene or pornographic material that does not align with our branding.
• Free of content promoting discrimination, hate, violence, illegal substances, or unsafe activities.
• Free of competitive brands shown or mentioned in the same post without prior approval.
Prohibited Activities (violation may result in immediate termination and forfeiture of all pending commissions):
• Spam, unsolicited communications, fake engagement (bots, purchased followers, cookie stuffing, adware).
• Bidding on our trademarks (“Girlie Lingerie”, “girlielingerie”, or variations) in paid search, social, or shopping ads.
• Sharing tracking links or codes on third-party coupon, discount, or deal websites, or any external sites outside your approved personal social channels.
• Self-referrals or fraudulent activity.
• Using our name, logos, or assets in a misleading, derogatory, or unauthorized manner (including domains or handles containing our marks).
• Content that could bring our brand into disrepute or associate our lingerie with illegal or unsafe contexts.
5. Intellectual Property
We grant you a limited, non-exclusive, revocable license to use our approved trademarks, logos, and materials solely for permitted promotion under these Terms. You may not modify them.
You grant us a perpetual, royalty-free, worldwide, irrevocable license to use, repost, modify, and display your promotional content (including photos, videos, name, likeness, and social handles) in our marketing, website, and social channels, with no further compensation or notice required. You waive any moral rights in such content.
All our intellectual property remains ours. You may not register or use any domain, social handle, or keyword that mimics or includes our trademarks.
6. Confidentiality and Independent Contractor Status
You may receive non-public information (e.g., upcoming products or pricing) and must keep it confidential except as required by law.
You are an independent contractor, not our employee or agent, and have no authority to bind us.
7. Termination
We or you may terminate participation at any time, with or without cause, upon email notice. Upon termination, you must immediately stop using our links, codes, and assets. We may withhold final commissions for up to 90 days to account for returns, chargebacks, or investigations.
We may suspend or terminate immediately (and withhold commissions) for any violation, suspected fraud, prolonged inactivity, or actions harmful to our brand.
8. Indemnification
You agree to indemnify, defend, and hold harmless Girlielingerie LLC and our officers, employees, and agents (“Released Parties”) from any claims, losses, damages, liabilities, and expenses (including reasonable attorney fees) arising from your breach of these Terms, your promotional activities, or our permitted use of your content.
9. Disclaimers and Limitation of Liability
The Program is provided “as is” without warranties. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the commissions paid to you in the 12 months preceding any claim.
10. Changes to the Program
We may modify commissions, rules, or the Program at any time with notice via email or the affiliate portal. Continued participation constitutes acceptance. If you do not agree, you must terminate immediately.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws principles. Any disputes arising out of or relating to these Terms, the Program, or your participation shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
Waiver of Right to Bring Class Action and Representative Claims:
To the fullest extent permitted by applicable law, you waive any right to bring or participate in any class action, collective action, representative action, private attorney general action, or any other proceeding in which you seek to represent others or act on behalf of a group. All claims must be brought on an individual basis only. You further agree not to join or consolidate claims with those of any other person or entity.
12. Miscellaneous
These Terms constitute the entire agreement. We may assign them; you may not. If any provision is invalid, the remainder remains enforceable.
